AGREEMENT TO TERMS
These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and LearnElectronics India ("Company", “we”, “us”, or “our”), concerning your access to and use of the LearnElectronics India's website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.
Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the “Last Updated” date of these Terms of Use, and you waive any right to receive specific notice of each such change. Please ensure that you check the applicable Terms every time you use our Site so that you understand which Terms apply. You will be subject to and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Use by your continued use of the Site after the date such revised Terms of Use are posted.
The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Site from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.
TERMS OF PAYMENTS:
These terms of payment outline the conditions and terms under which payments will be made by customers of our e-learning platform. By using our platform and making a payment, you agree to abide by these terms:
1. Payment Methods: We accept payments through various secure online payment methods, including credit/debit cards, net banking, digital wallets, and other authorized payment gateways.
2. Currency: All payments shall be made in Indian Rupees (INR), unless stated otherwise.
3. Payment Security: We ensure the highest level of security for all online transactions. Your payment details will be encrypted to safeguard against unauthorized access or disclosure. In any unexpected course of events, if the money gets deducted from your account before you purchase the product(s) from our website, please inform our team at the earliest.
4. Payment Confirmation: Upon successful payment, you will receive a confirmation email or notification containing the details of your purchase and payment.
5. Price & Discounts: All prices displayed on our platform are inclusive of applicable taxes, unless explicitly stated otherwise. In times of promotions and sales, you can purchase the product(s) or content at discounted prices. Please note that we frequently provide discounts to the new users and these particular discounts will not be applicable to the old users. Nonetheless, the final price of the product will be determined during the check-out process, therefore, it is your sole responsibility to verify the prices before purchasing the product(s).
6. Refunds: Refunds are not applicable for any digital program or content. Please refer to our refund policy to know more about your right to refund.
7. Non-transferability: Payments made for courses and programs on our platform are non-transferable. You are not allowed to transfer your payment or access rights to another individual or entity.
8. Subscription Plans: If you choose a subscription-based payment plan, you will be billed automatically as per the agreed frequency (monthly, quarterly, annually, etc.). You have the option to cancel the subscription at any time, as per the cancellation policy mentioned separately.
9. Late Payments: In the event of a payment delay, we reserve the right to suspend or restrict your access to the course or program until the outstanding payment is cleared.
10. Taxes and Duties: Any applicable taxes or duties levied by the government authorities will be added to the invoice amount, as per the prevailing regulations.
11. Modification of Payment Terms: LearnElectronics India holds the right to modify these terms of payment at any time. Changes will be effective immediately upon posting on our platform. It is your responsibility to review the terms periodically to stay updated.
12. Disputes: Any disputes or discrepancies related to payments shall be resolved through mutual discussions and negotiations. In case of failed resolution, the appropriate legal authorities in India will have jurisdiction over any legal proceedings.
By making a payment on our platform, you acknowledge that you have read, understood, and agreed to abide by these terms of payment. Please reach out to our customer service team in case of any misunderstandings or doubts.

These terms of Participation are applicable for all the above-mentioned Services but are not limited to them i.e. it may be also applicable to any other Services that we shall introduce in the future.
We encourage you to take part in our resourceful and innovative online courses, training, and all other services that we offer, which will surely uplift your skills and enrich your knowledge. By enrolling in any of the services offered by LearnElectronics India, you acknowledge and agree to abide by these Terms of Participation -
1. Eligibility: You must be at least 14 years old to participate in any online course, training program, or other services offered/conducted by LearnElectronics India. By enrolling, you confirm that you meet this eligibility requirement.
2. Enrollment: All enrollments are or may be subject to availability and approval by LearnElectronics India. We reserve the right to reject any enrollment at our discretion.
3. Payment: You agree to pay the required fees for the online course, training program, or any other service at the time of enrollment. All fees are non-refundable and non-transferable unless otherwise specified in our refund policy.
4. Materials and Resources: Learners will be provided with access to materials, resources, and learning platforms for the duration of the program. These materials are for personal use only and may not be distributed or shared with others without explicit consent from LearnElectronics India.
5. Attendance and Participation: Learners are expected to actively engage in the course by attending all live sessions, completing assigned coursework, and participating in discussions and activities as required. It is a learner’s responsibility to access and utilize the course materials within the designated time frame.
6. Code of Conduct: LearnElectronics India promotes a respectful and inclusive learning environment. You agree to behave in a professional and respectful manner towards instructors and fellow learners at all times. Any form of harassment, discrimination, or inappropriate behavior will not be tolerated and may result in immediate termination from the program.
7. Progress Tracking and Assessments: Progress may be tracked through quizzes, assignments, or exams. Learners are responsible for completing all required assessments to the best of their abilities. Any form of cheating or plagiarism will lead to consequences as determined by LearnElectronics India.
8. Changes and Cancellation: LearnElectronics India reserves the right to make changes to the content, schedule, or instructors if necessary. In the event of any cancellation by LearnElectronics India, learners will be eligible for a prorated refund as per our refund policy.
9. Privacy and Data Usage: LearnElectronics India will collect and process personal data provided by learners for enrollment purposes and course administration. By enrolling in the program, you consent to the collection, storage, and use of your personal data in accordance with our Privacy Policy.
10. Governing Law: These Terms of Participation shall be governed by and interpreted in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the Indian courts.
11. Certification: For any Services where we claim to provide a Certificate, the Participant/s is/are required to successfully complete all assigned projects, tasks, and Chapters, and a certificate of completion will be issued upon successful fulfillment of all requirements.
12. Refund Policy: There is no refund applicable for any of the Paid Services we provide or will provide regardless of the reason.
13. Termination: LearnElectronics India reserves the right to terminate a participant for reasons including but not limited to disobedient behavior, prolonged absence without notification, misconduct, or any other valid reason at the discretion of the program coordinators.
14. Compliance: Participants are expected to adhere to the guidelines and instructions provided by LearnElectronics India.
LearnElectronics India holds the right to modify or change these Terms of Participation at any time and changes, if any, will be updated on the website. It is the users' responsibility to stay up-to-date with LearnElectronics India's updated policies.
INTELLECTUAL PROPERTY RIGHTS
Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, international copyright laws, and international conventions. The Content and the Marks are provided on the Site “AS IS” for your information and personal use only. Except as expressly provided in these Terms of Use, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.
Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. USER REPRESENTATIONS

We make every effort to display as accurately as possible the colors, features, specifications, and details of the products available on the Site. However, we do not guarantee that the colors, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colors and details of the products. All products are subject to availability, and we cannot guarantee that items will be in stock. We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change.
PURCHASES AND PAYMENT
We accept the following forms of payment:
You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in Indian Rupees.
You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees, and you authorize us to charge your chosen payment provider for any such amounts upon placing your order. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.
We reserve the right to refuse any order placed through the Site. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

Any Content or website that contains material that, in our judgment, is pornographic, sexually explicit, obscene, or violent in nature;

Any Content or website that promotes encourages or engages in terrorism, or violence against people, animals, or property;

Any Content or website that is designed or used to hack or break into remote systems;

Any Content or website that is set up to function as an open HTTP proxy;

Any Content or website that is designed or used to commit or facilitate any "phishing" attack;

Any Content or website that contains any malware, including, but not limited to, software viruses, trojan horses, worms, time bombs or any other computer codes, files, or programs designed to interrupt, destroy, impair or limit the functionality of any computer software, hardware, telecommunications equipment or other device or equipment;

Unsolicited or bulk email (SPAM), including, but not limited to, using the Service's SMTP service or mail script to send out SPAM over our networks or other systems with a message referencing their website. SPAM is defined in paragraph (C)(3)(c). Our definition of SPAM is different from the CAN-SPAM Act, please read it;

"Snowshoe spamming" (which, generally, is an abusive technique used to send SPAM from a variety of IP addresses in an effort to spread out the SPAM load);

Any Content or website that is, in our judgment, designed to function as a farming bitcoin, bit-torrenting, pirated software website or illegal or unlicensed software or 'warez' website;

Any Content or website that contains or facilitates access to any material that is prohibited by Media Temple;

Any Content or website that, in our judgment, is designed or used to exploit, extract or otherwise gather any content or information from any Media Temple database, including, but not limited to, incorporating data from any Media Temple database into any email or "white-pages" products or services, whether browser-based, based on proprietary client-side applications, web-based, or otherwise;

Any Content or website that, in our judgment, is designed or used to reverse engineer, hack into, invade or otherwise gain unauthorized access into any of our systems, communications devices, or resources, or any other systems, communications devices, or resources (including, but not limited to security probing activities or other attempts to evaluate the security integrity of a network or host system without permission);

Any Content or website that, in our judgment, is designed for, used to, operated as, or for purposes of topsites; IRC scripts/bots; IRCD (irc servers); proxy scripts/anonymizers; image hosting scripts (similar to Photobucket or Tinypic); AutoSurf/PTC/PTS/PPC sites; IP scanners; bruteforce programs/scripts/applications; mail bombers/spam scripts; banner-ad services (commercial banner ad rotation); file dump/Mirror scripts (similar to rapidshare); commercial audio streaming (more than one or two streams); escrow/bank debentures or bank debenture trading programs; high-yield interest programs (HYIP) or related sites; investment sites (e.g. FOREX, E-Gold Exchange, Second Life/Linden Exchange, Ponzi, MLM/Pyramid Scheme); sale of any controlled substance without prior proof of appropriate permits; prime banks programs; lottery/gambling sites; MUDs/RPGs/PBBGs; hacker focused sites/archives/programs; fraudulent sites (including, but not limited to sites listed at aa419.org & escrow-fraud.com); push button mail scripts; broadcast or streaming of live sporting events (e.g. UFC, NASCAR, FIFA, NFL, MLB, NBA, WWE, WWF, etc); "tell a friend scripts"; anonymous or bulk SMS gateways; websites advertised via SPAM ("Spamvertised"); organization, entities or websites listed in the ROKSO database; PayDay loan sites (including any site related to PayDay loans, PayDay loan affiliate programs, etc); or mailer pro.
In the interest of maintaining a functional, high-class, professional service, we have conditions for users of our Service. While some of these conditions may seem harsh, please understand that they are necessary given the ever-evolving nature of the World Wide Web. Some of our competitors may not require their customers to comply with such conditions, and if any of our existing or potential customers are unwilling or unable to comply with these conditions, we get it, and we respectfully invite them to seek service elsewhere.
USER-GENERATED CONTRIBUTIONS
The Site does not offer users the to submit or post content. We may provide you with the opportunity to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or on the Site, including but not limited to text, writings, video, audio, photographs, graphics, comments, suggestions, or personal information or other material (collectively, "Contributions"). Contributions may be viewable by other users of the Site and through third-party websites. As such, any Contributions you transmit may be treated in accordance with the Site Privacy Policy. When you create or make available any Contributions, you thereby represent and warrant that:

The creation, distribution, transmission, public display, or performance, and the accessing, downloading, or copying of your Contributions do not and will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark, trade secret, or moral rights of any third party.
2. You are the creator and owner of or have the necessary licenses, rights, consents, releases, and permissions to use and to authorize us, the Site, and other users of the Site to use your Contributions in any manner contemplated by the Site and these Terms of Use.
3. You have the written consent, release, and/or permission of each and every identifiable individual person in your Contributions to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of your Contributions in any manner contemplated by the Site and these Terms of Use.
4. Your Contributions are not false, inaccurate, or misleading.
5. Your Contributions are not unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation.
6. Your Contributions are not obscene, lewd, lascivious, filthy, violent, harassing, libelous, slanderous, or otherwise objectionable (as determined by us).
7. Your Contributions do not ridicule, mock, disparage, intimidate, or abuse anyone.
8. Your Contributions are not used to harass or threaten (in the legal sense of those terms) any other person or to promote violence against a specific person or class of people.
9. Your Contributions do not violate any applicable law, regulation, or rule.
10. Your Contributions do not violate the privacy or publicity rights of any third party.
11. Your Contributions do not violate any applicable law concerning child pornography, or otherwise intended to protect the health or well-being of minors;
12. Your Contributions do not include any offensive comments that are connected to race, national origin, gender, sexual preference, or physical handicap.
13. Your Contributions do not otherwise violate, or link to material that violates any provision of these Terms of Use, or any applicable law or regulation.
Any use of the Site or the Marketplace Offerings in violation of the foregoing violates these Terms of Use and may result in, among other things, termination or suspension of your rights to use the Site and the Marketplace Offerings.
CONTRIBUTION LICENSE
You and the Site agree that we may access, store, process, and use any information and personal data that you provide following the terms of the Privacy Policy and your choices (including settings).
By submitting suggestions or other feedback regarding the Site, you agree that we can use and share such feedback for any purpose without compensation to you.
We do not assert any ownership over your Contributions. You retain full ownership of all of your Contributions and any intellectual property rights or other proprietary rights associated with your Contributions. We are not liable for any statements or representations in your Contributions provided by you in any area on the Site. You are solely responsible for your Contributions to the Site and you expressly agree to exonerate us from any and all responsibility and to refrain from any legal action against us regarding your Contributions.
SUBMISSIONS
You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information regarding the Site or the Marketplace Offerings ("Submissions") provided by you to us are non-confidential and shall become our sole property. We shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you. You hereby waive all moral rights to any such Submissions, and you hereby warrant that any such Submissions are original with you or that you have the right to submit such Submissions. You agree there shall be no recourse against us for any alleged or actual infringement or misappropriation of any proprietary right in your Submissions.
SITE MANAGEMENT
We reserve the right, but not the obligation, to:
(1) monitor the Site for violations of these Terms of Use;
(2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms of Use, including without limitation, reporting such user to law enforcement authorities;
(3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof;
(4) in our sole discretion and without limitation, notice, or liability, to remove from the Site or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems, and
(5) otherwise manage the Site in a manner designed to protect our rights and property and to facilitate the proper functioning of the Site and the Marketplace Offerings.
TERM AND TERMINATION
These Terms of Use shall remain in full force and effect while you use the Site. WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS OF USE, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SITE AND THE MARKETPLACE OFFERINGS (INCLUDING BLOCKING CERTAIN IP ADDRESSES), TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE TERMS OF USE OR OF ANY APPLICABLE LAW OR REGULATION. WE MAY TERMINATE YOUR USE OR PARTICIPATION IN THE SITE AND THE MARKETPLACE OFFERINGS OR DELETE ANY CONTENT OR INFORMATION THAT YOU POSTED AT ANY TIME, WITHOUT WARNING, IN OUR SOLE DISCRETION.
If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.
MODIFICATIONS AND INTERRUPTIONS
We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Site. We also reserve the right to modify or discontinue all or part of the Marketplace Offerings without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site or the Marketplace Offerings.
We cannot guarantee the Site and the Marketplace Offerings will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Site, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Site or the Marketplace Offerings at any time or for any reason without notice to you. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use the Site or the Marketplace Offerings during any downtime or discontinuance of the Site or the Marketplace Offerings. Nothing in these Terms of Use will be construed to obligate us to maintain and support the Site or the Marketplace Offerings or to supply any corrections, updates, or releases in connection therewith.
DISPUTE RESOLUTION
Informal Negotiations
To expedite resolution and control the cost of any dispute, controversy or claim related to these Terms of Use (each "Dispute" and collectively, the “Disputes”) brought by either you or us (individually, a “Party” and collectively, the “Parties”), the Parties agree to first attempt to negotiate any Dispute (except those Disputes expressly provided below) informally for at least 90 days before initiating the arbitration. Such informal negotiations commence upon written notice from one Party to the other Party.
Restrictions
The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. To the full extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class-action procedures, and (c) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
Exceptions to Informal Negotiations and Arbitration
The Parties agree that the following Disputes are not subject to the above provisions concerning informal negotiations binding arbitration: (a) any Disputes seeking to enforce or protect, or concerning the validity of, any of the intellectual property rights of a Party; (b) any Dispute related to or arising from, allegations of theft, piracy, invasion of privacy, or unauthorized use; and (c) any claim for injunctive relief. If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable, and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.
CORRECTIONS
There may be information on the Site that contains typographical errors, inaccuracies, or omissions that may relate to the Marketplace Offerings, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Site at any time, without prior notice.
DISCLAIMER
THE SITE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SITE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
